ABSTRACT: This paper aims to make a comprehensive study on how the current legislation in Spain favors or not the use of biomass as a primary energy mainly for power generation, biofuels production or as fuel in boilers to heat input.A review is made of current legislation, both Spanish and European, and analyzes the influence it is having and may have in increasing the use of biomass as fuel.The results of the Renewable Energy Plan PER 2005-2010 are studied, mainly regarding the generation of electricity from biomass, concluding that the power plants with biomass not reach proper operating hours to ensure that projects can be viable.Finally the measures outlined in the PER Renewable Energy Plan 2011-2020 to promote the use of biomass as fuel are analyzed and discussed the effects of recent legislation in the energy sector.As a final conclusion is deduced that remains to be done, in the Spanish regulatory framework, so that biomass can be consolidated as an alternative to other energy sources predominant, such as fossil fuels.Lawmakers need to assess not only economic costs but also environmental costs and long-term impact of pollution in all its forms.Keywords: Biomass; Power generation, Legislation, Renewable Energy Plans, Biofuels
