ABSTRACT: Public procurement is one of the cornerstones of the construction sector and know its normative regulation is one of the key aspects to achieve success. The Administration regulates the concept of disproportionate offer to avoid offers too low which may endanger the execution of the work or cause problems during execution, as numerous conflicting prices, modified projects or delays in the implementation.Criteria for determining the disproportionality of tenders there are many and each contracting authority determines which will be used in each of your procedures, carrying out a comparative analysis between them in this article.Results show us that formulas of disproportionality based on a percentage on tender price are not useful and the desirability of formulas based on the determination of a reference low calculated from the average deviation of bids and offers.Keywords: public procurement, tenders disproportionate, construction, project management.
